How to Solve ‘ No Changes Have Been Made to The Scanned File’ Error Running Scanpst?

Tort Reform – Changes in Personal Injuries

GOLIATH DOESN’T NEED HELP

If after David beat Goliath the government decreed that henceforth when people fight giants, they must do so with six-inch sling shots and pebbles instead of rocks, there would be a huge outcry of protest.  However, the changes that are being imbedded in our legal system in the name of tort reform are attempting to do the same thing.

 

There have been efforts (some successful) in Congress and many state legislatures to make it more difficult for an injured person to pursue a lawsuit and to limit the amount that can be recovered.  Part of the impetus for this reform is a misconception that injured people are somehow taking advantage of insurance companies and corporate America.  The truth is before an individual files a lawsuit against a large business, he or she better be armed with more than a slingshot as there is a long tough battle ahead that usually will not be won unless the facts warrant such and sometimes not even then.

 

Another reason people feel reform is necessary is the perception that unscrupulous, greedy lawyers are ruining the system.  Obviously the over-zealous conduct of some attorneys needs to be curtailed.  However, such conduct is exhibited by both plaintiff and defense counsel.   So, if any changes are made to the system, we must make certain they equally impact both sides and do not adversely affect the ability of an injured person to obtain fair compensation.

 

From time to time an individual will receive an outlandish jury award for a small case.  This is akin to someone continually playing a slot machine and eventually hitting the jackpot.  It is these jackpots that receive big press coverage because instant wealth is deemed newsworthy.  However, simply because this occasionally happens doesn’t mean that we need to toughen the odds from it happening again.

 

 There are already many safeguards in place in our legal system to prevent outrageous results.  For example, a judge has the power to reduce a jury award when it is deemed appropriate.  This is far more appropriate than an across-the-board money cap imposed by a legislative body.  The judge knows the law, is familiar with the case, and can recognize an absurd dollar amount.  Unfortunately, these judicial reductions usually are back page news items compared to an initial award decision.

 

When an individual is hurt or injured, it can be extremely difficult to receive fair compensation as he or she is usually doing battle with a giant in the form of a big corporation, an entity with unlimited legal resources.  The expenses attached to a lawsuit dictate that the injured person thoroughly explore a settlement for a sum close to what is fair before filing suit.  To suggest that these individuals take advantage of big companies in the legal arena is as illogical as saying that David took advantage of Goliath.

 

Do we really want to limit the amount of money a person can receive to a figure such as $250,000.00 plus medical bills?  This may seem like a lot of money that could keep most of us happy for a long time, but it is usually insufficient when an injured victim has a permanent disability that will affect the individual’s quality of life for the remainder of their life.  Imagine only receiving $250,000.00 if you lose or limb or are paralyzed.

 

Before supporting tort reform we must remember that the playing field is already tilted in favor of the giants.  It seems totally inappropriate to tilt the field even more.  David has a tough enough job.

Fauvism from France and Di Bruke in Germany were brought on by Post Impressionism and Art Nouveau from the 19th century. This was from the Modernism period of art.

A non representation of color is the main focus of France’s Fauvism in figurative paintings. Emotion is the focus of Die Brucke. The Renaissance movement is art was challenged by Picasso’s Cubism. Machine age images is the focus in Futurism. In Russian, Suprematism was a huge movement. Surrelism evolved from Dadism which attacked ideas of art and broke down differences in low and high culture. Surrelism revealed the subconscious and was influenced by automatism.

Freud made strides in Psychology and this led to dream and unconscious depictions by artists such as Salvador Dali. Jackson Pollock and Mark Rothko revealed imagery that was detached in the 1950′s. Commercial imagery began with Andy Warhol. He minimized the art and this brought change from Modernism to Post Modernism. This was a huge art movement. The change from Modernism to Post Modernism brought changes in art and also used installation art, intermedia art and conceptual art. This movement believed in the importance of learning. They also believe that you can’t just learn knowledge- you actually need to use it towards something. This became the disillusionment of art. It expresses these ideas. Post Modernism reveals the sentiments of the culture and the rejection of the ideas from the past generations. Most Post Modernist artists reject the ideas brought on from the renaissance period as well as the Modernist period.

Art changes with the culture and society. You can tell a lot about a culture through its art and also through its changes in its art. To learn about a society you must learn about their art. Study the changes and major events that change the art. This is all important. You will find that artists represent the changes they feel and see in their world around them. They tend to be the eyes of the culture. Sometimes culture can change art and other times art seems to change culture. It is a strange relationship that is worth studying. New Changes Planned for the New York Schools by the State’s New Governor

Many states are experiencing the shock of new governors who are breaking the mold of former elected officials. In past generations, new state governors created a transitional governing period during which they and their staffs could get up to speed on the operations and issues of their states’ governments. In 2007, many new governors are hitting the ground running. Transitional periods seem to be nonexistent with the newly elected governors barely settling into the governor’s residence before making changes within their states.

New York’s new democratic governor is such an elected official. Governor Eliot Spitzer was swore in on January 1st, taking his oath of office and delivering his inaugural speech. By the end of January, he already has formulated new plans to put the New York schools and its students back on the road to success.

Spitzer’s major push is his series of “Contracts for Excellence”, which are methods and programs to improve the New York schools and the education its students receive.

One initiative will provide a significant increase in state aid to poorly performing districts within the New York schools. Of course, this increase in funding has strings attached that the governor believes will set a new course for success for the problem schools. New York schools receiving the extra funding must justify any improvements to their facilities. They also must set goals for their New York schools’ students’ performance. If these New York schools meet their goals, they will receive special recognition for their success, along with the possibility of receiving even more funding. Failing to meet their goals, however, means these New York schools risk funding penalties and the removal of superintendents, principals, and even school district board members.

A second initiative from Spitzer is report cards for New York schools’ leadership. In a recent speech at the State Education building in Albany, Spitzer stated that currently only New York schools’ students and their schools receive report cards. Soon, the New York schools’ leadership will begin receiving annual report cards that will track the performance of district superintendents and individual school principals from year-to-year. For the first time, the New York schools will be able to rigorously compare and evaluate their performance with the report cards following them from one school district to another within the state of New York.

Other initiatives under Spitzer’s Contracts for Excellence for the New York schools are:

• A universal pre-kindergarten for all four-year-olds within the New York schools’ area by 2010. All children deserve the opportunity to get a head start on education through this uniquely designed preschool period of acclimatization.

• The class sizes in the New York schools are much too large, making students in large classrooms difficult to teach and learning next to impossible for the children. Spitzer sees smaller class sizes as a must for educational success within the New York schools.

• Spitzer wants the cap on public charter schools within the New York schools to be raised from the current 100 to 250. Many see these public school academies as the solution to poor performing traditional New York schools. The charter schools also will be required to meet their own “Contract for Excellence” every five years in order to remain open.

• The governor wants to appoint a “Children’s Cabinet” to assist with and guide the improvement efforts of the New York schools. The cabinet will be comprised of regents, education experts, and the state education commissioner.

Lastly, Spitzer announced his appointment of Manny Rivera as his new deputy secretary for education. Rivera is the former superintendent of schools in Rochester, New York.

Though Spitzer did not provide any details of how his proposals will be implemented or from where the funding will come, he did note that his plans will be meticulously formulated in detail during the creation of the state’s budget proposal to the legislature.
